What are the laws about domain name registration?
Thursday, January 21st, 2010Lets say I own ABC INC, own the trademark, own ABC.com, .de, .eu, and a few other ABC domains and registered with the World Intellectual Property Organization. Then, a few years later another party decides to register ABC.info, .biz, .asia, .in, .tw, .net, etc.
What rights do I have as the original owner of the company and domain name to keep the second party from registring those domains using ABC?
To prevail in a domain name dispute at the UDRP, you will need to must that the disputed domain name is being used in bad faith. Thus, if the person registering ABC.info, .biz, etc has a legitimate right to the trademark ABC, then you will likely have no recourse.
Keep in mind that a trademark does NOT mean you have a monopoly on a name. Consider, for example, the trademark "Delta" for an airline, faucets, and tools. All three companies may have a legitimate right to domain names containing "Delta".
