What are the laws about domain name registration?

Thursday, January 21st, 2010

Lets say I own ABC INC, own the trademark, own ABC.com, .de, .eu, and a few other ABC domains and registered with the World Intellectual Property Organization. Then, a few years later another party decides to register ABC.info, .biz, .asia, .in, .tw, .net, etc.

What rights do I have as the original owner of the company and domain name to keep the second party from registring those domains using ABC?

To prevail in a domain name dispute at the UDRP, you will need to must that the disputed domain name is being used in bad faith. Thus, if the person registering ABC.info, .biz, etc has a legitimate right to the trademark ABC, then you will likely have no recourse.

Keep in mind that a trademark does NOT mean you have a monopoly on a name. Consider, for example, the trademark "Delta" for an airline, faucets, and tools. All three companies may have a legitimate right to domain names containing "Delta".

Domain name registration for LLC and Whois lookup?

Sunday, January 10th, 2010

Sometimes you can see who is the owner of any domain name using Whois Lookup service . Sometimes you see the company name only, no first and last name of the owner. Sometime you see both - company name and owner of the company.
What are the correct steps to register a domain name for LLC without sharing information about the LLC Owner/Administrator/Domain Manager/etc First and Last names?

Of course that should be legal and made regarding US rules.
Thank you.

You can do either, legally

domain name registration lapsed How do I re-reg without paying the high fee to the current holding company?

Thursday, January 7th, 2010

My domain name is still in my name but I can’t register it anywhere else until it goes public. Is there a way around this?

No, there is no way around this.

You can try to wait to until the holding period is over and register for the name again, but that can be dangerous since anyone can grab the name before you do.

I have questions regarding my specific domain name registration and forwarding on yahoo. Who can I talk to?

Sunday, November 8th, 2009

I couldn’t find my answers on the website.

It appears that the question period has expired. If you have received an answer that meets your needs, _please_ choose one of those as a ‘best answer’ as soon as you can; otherwise, this question will go to an automatic vote. If you haven’t received a good answer for your question, you may want to consider the following,

1) Remove this version of your question and re-post your question. Newer questions get more activity on Yahoo! Answers than old ones.
2) If you do re-post your question, consider why it wasn’t answered the first time. Could it be more specific? Could it be worded better? Were there grammatical or spelling errors? Was it in the best category? Can you provide more helpful details?

If it doesn’t seem likely that re-posting your question will help you, then here’s a listing of my favorite ‘answer sites’. Maybe one of them will help you.

Bartleby http://www.bartleby.com/
Yahoo Reference http://education.yahoo.com/reference/…
HowStuffWorks http://www.howstuffworks.com/

Since I really haven’t answered your question, it is not necessary to give me any points. Regards.

What can you do if a host is hanging on to your domain name after the registration period has expired?

Sunday, November 1st, 2009

I bought a package website eighteen months ago but have now decided to design my own site. I allowed the registration period to elapse in July so I could register with another host, but the host is still listing the site as mine three months later. Can anyone suggest a course of action to get them to release it? I’ve tried contacting them directly but they just tell me it will be released soon…
The host is Freestart.

Unfortunately what you posted is a common but wrong assumption. The moment you allow your domain name registration to expire, you are considered to have abandoned your rights to it. (well almost all…)

By then you really have no right to tell them to release it just because you once had it. They can hold on to it as they see fit, though there can be certain restrictions depending on their agreements with whomever they’re doing business with.

If the domain name really means a lot to you, I suggest you bite the bullet and renew it with your current provider instead. It’s too risky to hope you’ll be able to re-register it with someone else, and you have ZERO assurance you’ll be able to do that.

Domain name registration and Credibility?

Friday, October 23rd, 2009

Suppose if some ‘John Grisham’ registers a domain www.legalthrillers.com. , but gives details of his identity as ‘John Bosham’.What are the legal implications? Can John Grisham claim it’s his domain in case of a dispute? In which way can he?

Because as far as I see domain registrars do not ask for any Identity Documents. If payment too is made with an fake paypal account. How can domain his ownership be determined?

Thank you.

Some domain sellers, like http://www.JordanSoft.com, offer free change of registration. This means you can assign your domain name to another registrant, right online. You can change all four contact fields for the domain whenever you want.

In your case, ‘John Crisham’ can simply change the registrant to his own name. If the current domain seller does not offer this option, ‘John Crisham’ can simply trasfer the domain to a seller like http://www.JordanSoft.com and then change the registrant.
